Terms of Use Agreement
Our Terms of Use Agreement (“Agreement”) applies to and governs all websites, digital downloads, and software made available by Stories to Grow by, Inc. (“STGB”) at www.storiestogrowby.org (“the Site”) on mobile devices, tablets, personal computers and other devices. STGB is a nonprofit 501(c)3 entity organized as part of The Lindy Foundation, a private foundation.
We at STGB welcome you to the Site. Please review the following basic rules that govern the use of the Site ("Agreement"). Please note that your use of the Site constitutes your agreement to follow and be bound by these rules and our policies. If you do not agree with the Agreement in its entirety, you should not use the Site.
A separate document, Privacy Policy, explains how we collect and use personal information that you provide to us.
A separate document, Limited Performance Rights Policy, explains the rights you purchase when you purchase a play script from Stories Site.
Ownership of Site Contents
Unless otherwise noted, all text, images, illustrations, designs, icons, photographs, video clips, site code, and other materials that are part of the Site, including any text provided on the Site (collectively, "Contents"), are copyrighted works, trademarks, trade dress, or other intellectual properties owned, controlled, or licensed by STGB, and are protected by U.S. and worldwide copyright laws. The Site as a whole are protected by copyright and trade dress. The phrases storiestogrowby.org, and storiestogrowby.com are trademarks of STGB. Any other trademark, service mark or trade name of STGB used in the Site are trademarks or registered trademarks, service marks or trade names of STGB.
Legal notices and credits are posted on various webpages of the Site, and these notices and credits may not be removed. Please do not remove any such notice or credit, or any additional information contained along with the notices and credits.
Downloading
By way of definition:
On the Site, an individual digital product for sale is referred to as a “Digital Product.” The selection of digital products available for sale from the Site, collectively, is referred to as the “Digital Products.”
On the Site, for your right to download and copy a Digital Product that is a play script, see the Limited Performance Rights Policy (“LPRP”).
Whether you download or copy a Digital Product from the Site, no title or ownership interest is transferred to you as a result of the downloading, copying, or licensing.
You may not reproduce, transmit, or distribute in any way, in whole or in part, any of the Contents of the Site, unless otherwise expressly permitted in this Agreement or in the LPRP. You may not display, modify, create derivative works from, sell or exploit in any way, in whole or in part, any of the Contents of the Site without the prior written consent of STGB.
You may not frame or utilize framing techniques to enclose any part of the Site. You may not use any meta tags or any other “hidden text” utilizing the name of STGB without express written consent. Legal notice and various credits appear on pages of the Site, and any such legal notification may not be removed.
Any unauthorized use terminates this Agreement granted by STGB. Illegal and/or unauthorized uses of the Site, whether for unauthorized framing of, or linking to, the Site, or otherwise, will be investigated and appropriate legal action will be taken, including, without limitation, civil, criminal and injunctive redress.
Third-party Links to the Sites, and Links from the Sites to Third-parties
STGB grants you a limited, revocable, and nonexclusive right to create hyperlinks to pages on the Site as long as the link does not portray STGB or any of its products or services in a false, misleading, derogatory, or otherwise offensive manner. You may not use the logo of STGB as part of a link without express written consent of STGB.
In an attempt to provide increased value to our visitors, STGB may link to third party sites. However, even if the third party site is affiliated with STGB, please note that STGB has no control over these linked sites, all of which have separate privacy and data collection practices, independent of STGB. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, STGB seeks to protect the integrity of its Site and the links placed upon each Site, and therefore requests any feedback on not only its own Site, but for third party sites it links to as well (including if any specific link does not work). If you have a problem or questions about a link from the Site, or have any other feedback, please notify us at info@storiestogrowby.org. We will investigate your claim and take any actions we deem appropriate in our sole discretion.
Privacy
Your privacy and the privacy of all our users is the highest priority at STGB. For more information, please review our Privacy Policy. You will see in the document a detailed description of STGB’s compliance with the Children’s Online Privacy Act of 1998.
Your Account
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. See the Privacy Policy for more information.
STGB reserves the right to refuse service, terminate accounts, remove or edit content, and cancel orders at our sole discretion.
Electronic Communications
By using the Site, you are communicating with us electronically. Use of the Site means you consent to receive communications from us electronically and agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
User Communication & Materials
Reviews, Forum Discussion, and Feedback, as further defined below, as well as any other communication or materials posted to or created by users accessing the Sites, including text, audio, video, or other format of communication is termed, collectively, “User Communication.”
Reviews
Any user review of a story, play script, or product; or any comment on said review of a story, play script or product; or any review of any other of the Contents of the Sites, that is disclosed, submitted or offered in connection with your use of the Sites (collectively, "Reviews"), shall be and remain STGB property and STGB shall have the right to reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way, in whole or in part, the Reviews without obtaining your prior consent. Discussion and Commenting
Any user discussion on a post on the Site, or any comment on said discussion, that is disclosed, submitted or offered in connection with your use of the Site (“Forum Discussion”), shall be and remain STGB property and STGB shall have the right to reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way, in whole or in part, the Forum Discussion without obtaining your prior consent. User Feedback
Any user feedback, suggestion or idea submitted or offered to the Sites or otherwise disclosed, submitted or offered in connection with your use of the Sites, or any comment on said user feedback, suggestion or idea (collectively, "Feedback") shall be and remain STGB property. STGB shall have the right to reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way, in whole or in part, the Feedback without obtaining your prior consent. STGB has no obligation to respond to User Communication.
You agree that any User Communication submitted by you on or about the Site will not violate any right of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary right(s).
STGB does not and cannot review all User Communication, and is not in any manner responsible for the content of User Communication, vetted or otherwise. STGB assumes no liability arising from the existence of any error, defamation, libel, slander, omission, falsehood, obscenity, profanity, danger or inaccuracy contained in any User Communication posted on the Site. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, STGB is merely acting as a conduit for such distribution and is not undertaking any obligation or liability relating to User Communication.
STGB reserves the right, but undertakes no duty, to review, edit, move, or delete any User Communication in its sole discretion and without notice. STGB reserves the right to block or remove User Communication that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to STGB at its sole discretion.
Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. You are prohibited from posting or transmitting any unlawful, threatening, defamatory, obscene, scandalous, inflammatory, pornographic, or profane materials or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Impersonation of others, including a STGB or other employee, host, vendor, or representative, as well as other any other member or visitor on the Site, is prohibited. You may not upload commercial content on the Site or use the Site to solicit others to join or become members of any other commercial online service or other organization.
STGB will fully cooperate with any law enforcement authorities or court order requesting or directing STGB to disclose the identity of anyone posting any User Communication.
Typographical Errors
In the event that a product sold on STGB is mistakenly listed at an incorrect price, or in any other way mistakenly described, STGB reserves the right to refuse or cancel any orders placed for product listed at the incorrect price or otherwise mistakenly described. STGB reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card was charged. If your credit card has already been charged for the purchase and your order is cancelled, STGB shall issue a credit to your credit card account in the amount of the incorrect price.
Disclaimer
The Site is provided by STGB on an “as is” and “as available” basis without warranties of any kind, either express or implied, as to the truth or accuracy of information on the Site. STGB assumes no liability or responsibility for any errors or omissions in the content on the Site. STGB makes no promises that the Site will provide specific results from any search or link on it. STGB makes no promises of any specific result from the use of the Site or the use of any services or products offered by STGB.
Your use and browsing of the Site is at your risk. Neither STGB nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Site. STGB cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. STGB is not liable for any damages to your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, audio, or Digital Product from the Site, whether through infection by a virus or otherwise, or by unauthorized action by any third-party 'hacker.' STGB assumes no liability or responsibility for any interruptions in service.

Indemnification
You agreed to defend, indemnify, and hold harmless STGB, its subsidiaries, affiliates, officers, employees, agents, authors, and contributors from and against any and all claims, damages, costs, and expenses, including attorney's fees, arising from any violation of this Agreement or any activity related to your use of the Site (including negligent or wrongful conduct), by you or made by any third party due to, or arising from, your use of the Site.
Choice of Law and Jurisdiction
Unless otherwise specified, the Site and the Contents thereof are displayed solely for the purpose of providing, enhancing, promoting, and furthering STGB's services and mission.
This Agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state or federal courts of the Commonwealth of Pennsylvania. You hereby agree to submit to the jurisdiction of any such court sitting in the Commonwealth of Pennsylvania and agree that venue is proper in the district wherein STGB is located.
Termination
STGB may terminate your use of the Site and may do so immediately without notice, and accordingly deny you access to the Site, and may bar you from future use of the Site, and may cancel your orders or subscriptions, and may exercise any other remedy available, and may take appropriate legal action against you, if in STGB's sole discretion you fail to comply with any term or provision of this Agreement. STGB is not required to provide any refund to you if you are termination as a user because you have violated this Agreement.
You agree that monetary damages may not provide a sufficient remedy to STGB for violations of these terms and conditions, and you consent to injunctive or other equitable relief for such violations.
STGB may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity.
Upon termination of this Agreement, you must promptly destroy all materials downloaded or otherwise obtained from the Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
Modifications
STGB may from time to time change the rules that govern your use of the Site. STGB will post these changes in our Agreement. Your use of the Site following any such change constitutes your agreement to follow and be bound by the rules as changed. STGB may change, move, or delete portions of the Site, or may add to the Site from time to time.
Assignment
In the event STGB may wish to assign or transfer your personal information and its rights hereunder to a third party, you agree that STGB may do so, on the condition that such third party agree to abide by STGB's then current Privacy Policies. For more information, see Privacy Policy.
